General

SilkRoadExplore.com acts as a booking agent for service providers advertised on the website www.silkroadexplore.com hereby referred to as the Site.

By using and/or visiting the Site you agree to the General Terms and Conditions and Privacy Policy and you expressly consent and agree to be bound by all terms and applicable laws and regulations that govern this Site and your booking.

Please take a moment to familiarize yourself with the Terms and Conditions before using the Site. They may have been amended since your last visit. 

If you do not agree to our Terms and Conditions please do not use our Site. The Terms and Conditions also apply when bookings are taken via telephone by one of our contact center staff members.

Occasionally additional terms and conditions may apply. Do not worry, the relevant terms and conditions will always be made clear at the time.

References to “service providers” mean tour operators and the owner/providers of the hotels, apartments and other accommodation of any description featured on this Site. “Service” means any accommodation, including all facilities and services advertised on our Site, that we have agreed to arrange in connection with your confirmed booking.

The liability of Silk Road Explore, LLC. is limited

Silk Road Explore and its suppliers reserve the right to vary itineraries in order to improve each tour for the tour members’ enjoyment and benefit. Silk Road Explore and its suppliers reserve the right to cancel or reschedule any tour departure in accordance with operation requirements.

Silk Road Explore is not liable for any losses, expenses or damages of any sort suffered by the client as a result of the acts, errors, omissions, breaches, negligence, fraudulent intent, misleading or untrue statements, breach of contract, breach of statutory duty, willful misconduct or any other tortious act attributable either wholly or in part to service providers or any other independent business or service suppliers who sell their products and services through us, including their employees, directors, officers, agents, representatives or affiliates. This means that in the event of you suffering personal injury, illness or death as a result of any act or omission of the service provider or other service suppliers (or their employees or agents) or you have any complaint regarding the quality of the services provided or have any other complaint at all, your sole right of redress will be against the independent third party that provided these services; Silk Road Explore is not held liable in any of these aforementioned circumstances (whether they be in contract, tort or otherwise). 

You understand that we may not have conducted any quality or other checks on the service providers and cannot attest to the suitability of the accommodation and/or services offered for sale through SilkRoadExplore.com. The inclusion or sale of accommodation and/or services by Silk Road Explore does not constitute an express or implied endorsement or recommendation by Silk Road Explore of such accommodation or services. We do not guarantee the accuracy of services and disclaim liability for any inaccuracies related to the accommodation and services offered for sale through us. Silk Road Explore is not held liable for any damages that arise as a result of any inaccurate information or errors on our Site which relate to tour package and accommodation information or any losses suffered by the client in the event of service providers overbooking, canceling bookings in full or in part, events of force majeure, or any other cause beyond our or their control. 

By proceeding to book accommodation and/or other services through Silk Road Explore.com or by contacting us via the phone or other means of communication listed on the Site, you accept that you will be entering into a contract with the service provider on their standard terms and conditions. If they are provided, we will endeavor, but undertake no liability, to make copies of the service provider’s terms and conditions available to you.  Please review the tour package information for any applicable terms and conditions.

Force Majeure

Silk Road Explore is not held liable for any changes, cancellations, effects on the client’s booking, loss, or damage suffered by the client or for any failure of the service providers and/or Silk Road Explore to perform any of our respective obligations to the client if the non-performance in question is caused by force majeure. By way of example force majeure includes, but is not limited to, war, revolution, acts of terrorism, closure of borders, epidemics, natural catastrophes or other unforeseeable causes and circumstances beyond Silk Road Explore’s control which seriously affect both parties.  

Before you travel

Silk Road Explore is not liable for damages or losses that may result from travel to any particular destination.

It is your responsibility to ensure you have all the relevant travel and health documentation necessary with you before entering Kyrgyzstan or any other country included as part of the tour package which includes, but is not limited to, any required inoculations, ID’s, passport, and/or any visa requirements. Silk Road Explore is not liable for incurred expenses resulting from your missing, incomplete or incorrect documentation or any non-compliance with requirements.

Complaints or issues with your tour package and/or accommodation

In the unlikely event that you have reason to complain or experience any problems with your tour package, please inform the service provider’s staff or management immediately to enable them to take appropriate action.  As stated above, service providers (not Silk Road Explore) are responsible for the information they upload to our Site including descriptions of the accommodation and/or services offered. If you think that the tour package or accommodation does not match the description you saw on the Site, please address your complaints to the service provider’s staff during your stay.

Site content, documentation and booking information.

Silk Road Explore may modify the content of the Site and/or Terms and Conditions at any time. Such modification shall be effective immediately upon posting of the modified content and/or Terms and Conditions on the Site and your continued use of or access to this website will be regarded as an indication of your acceptance of the modified content and/or Terms and Conditions.

Any information posted on the Site related to tour packages advertised on the Site including, but not limited to: tour package details, the availability of rooms at various accommodations, prices of tour packages and rooms, facilities available at various accommodations, any accreditations afforded to accommodations such as a star rating, or details related to any other services advertised on the Site have been placed on the Site by service providers who are independent businesses and are not agents or employees of Silk Road Explore or its affiliates. Such information does not constitute any advice or recommendation given by Silk Road Explore and Silk Road Explore shall not be held liable for inaccuracies or errors (including obvious manifest or typographical errors) in tour package information or any of its elements including rates and availability. These independent businesses provide these services in accordance with their own terms and conditions which may limit or exclude their liability to you.

IMPORTANT: Please note that any accreditations or descriptions of quality such as a star rating have been placed on the Site by service providers and not by us. We do not independently verify star ratings and the star is only indicative of what level of quality you can expect from a particular service provider. 

As Silk Road Explore acts only as a booking agent we take no responsibility for any errors or inaccuracies in documentation supplied by the service providers.

It is your responsibility to check the total price of the tour before completing the booking form by contacting our contact center staff members. Rates are posted on our Site by service providers, not by us.

Special Requests

If you have special requests pertaining to your tour package please let us know at the time of booking. This information will be given to the service provider. Such requests will be subject to availability and we cannot guarantee that this request will be met. If the service provider is unable to meet any such request, neither Silk Road Explore nor the service provider will be held liable to you in this respect. This request may only be available at an additional cost unless otherwise expressly stated in the description of the service provider, and if any additional cost is applicable, this should be paid by you directly to Silk Road Explore.

Personal information

To confirm a booking, you must be authorized to make the booking by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made. By making the booking, you are confirming that all persons named on the booking accept the Terms and Conditions and that you will inform the other persons named on the booking of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due under the booking.

The display of tour packages for sale on our Site is an invitation to treat only.

By continuous use or access to this website, you agree to these terms. By completing and submitting a booking form you are making an offer to book a tour package, which if accepted by the service provider, will result in a binding contract made between you and the service provider.

Tour confirmation

Prior to booking a tour package, you will receive a tour confirmation letter from us via email. You can complete your booking online or by telephone once you have confirmed your tour package by replying to us via email.  

This will form a legally binding contract subject to any applicable terms and conditions listed in this document.

Your credit or debit card details may be used by Silk Road Explore to carry out pre-authorization checks.  These details may also then be used by Silk Road Explore to take advance payment, a cancellation fee, or a no show fee, if applicable. We will only ever ask you to provide us with your card details on a secure booking form or directly over the phone to one of our contact center staff members.

Wherever Silk Road Explore processes your credit or debit card details in connection with the provision of a booking, they will be bound to obtain and maintain any necessary accreditation required to provide payment processing services to you and shall be obliged to operate in accordance with the standards outlined in the Payment Card Industry Data Security Standards (PCI-DSS) published on the website www.pcisecuritystandards.org. 

If a pre-authorization check is attempted and the card details provided are shown to not have sufficient funds or the pre-authorization fails for any other reason, we will attempt to contact you so that you can provide an alternative method of payment. Should you not respond to our emails within 48 hours we reserve the right to cancel your booking and rerelease your tour package or room for resale. 

To make a booking you will be asked to submit personal information about yourself such as your name, email address, physical address, telephone number, and credit card details (“personal information”). Whenever you provide such personal information, Silk Road Explore will collate and use this personal information in accordance with the Silk Road Explore Privacy Policy. Please read this in full before providing any Personal Information to Silk Road Explore. 

You hereby authorize Silk Road Explore to process all personal information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information includes, but is not limited to: any telephone numbers, fax numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information belonging to you or your group.

In the event that you call Silk Road Explore via telephone, or are called by Silk Road Explore regarding your booking, calls may be recorded for monitoring and training purposes. In the event of a dispute regarding a booking, Silk Road Explore reserves the right to review any call information.

Price, Payment and Receipt issue

Prices

Price quotations are subject to change without notice. Items not described in the tour packages’ description are not included.

Payment

All tours must be pre-paid except otherwise stated. We accept Visa, Mastercard, and transfers to our bank account.  The charge that will appear on your credit card statement will be under the name “SILK ROAD EXPLORE.” All payment processing fees must be paid by Payer.

Foreign Exchange Rates

You will be charged in USD at the exchange rate applicable on the date of your booking.  Currency exchange rates are based on various publically available sources and are updated daily; as such they will be subject to market fluctuations and should be used as guidelines. 

Receipt issue

After payment, Silk Road Explore will send you a receipt via e-mail or fax; this receipt must be printed as a proof of purchase and presented to the service provider.

All information regarding the group’s travelers should be correctly given at the time of booking.

Any requests for modifications/amendments must be sent by email or other means of communication listed on the Silk Road Explore Site.

Silk Road Explore cannot be held responsible for any problems that may occur if you don’t receive or carefully read your receipt. In the event that you do not receive your receipt, you must notify Silk Road Explore at least 72 hours before the date of service.

Cancellations, refunds, and procedure to cancel a booking

Cancellation fees/refunds

You may modify or cancel your booking prior to your arrival date by contacting us via telephone or other means of communication listed on the Site.

If you cancel or amend your booking, there may be a cancellation charge or amendment fee levied by the service provider.

Further cancellation policy details are shown on the tour’s details page prior to you making a booking. Please check these details thoroughly.

In any event, if you fail to cancel or amend your booking in accordance with the service provider’s cancellation or amendment policy, you will be charged a cancellation or amendment fee specified by the service provider on the tour’s details page.

If you cancel, amend or change a booking

If for whatsoever reason, you do not show up on the arrival date stated on your booking confirmation email without prior warning to Silk Road Explore, this shall be considered a cancellation. Silk Road Explore may charge you a cancellation fee using the credit or debit card details that you provided when securing your booking.
